License Agreement for Vivid Sparkles Users

This legally binding agreement (the "Agreement") regulates your use of the Vivid Sparkles software product (the "Vivid Sparkles Extension"), which includes the software as well as any supporting media and documentation that was given to you by the developer of Vivid Sparkles.

Installing the software, using the software, or gaining access to the software indicates that you agree to be bound by the terms of this EULA. If you do not agree to the terms of this End User License Agreement (EULA), do not install or use the software.

The Developer thus grants to the User, subject to the terms and conditions of this End-User License Agreement (EULA), a license to use the Software that is neither exclusive nor transferable. The user has the ability to install the program on any number of devices that they want.

The User is not entitled to edit, decompile, reverse engineer, or otherwise disassemble the Software unless specifically authorized to do so by law. It is strictly forbidden for the User to sublet, rent, or lend the Program to any third party. Utilization of the Program is not permitted to result in any monetary advantage of any kind. The User is not permitted to make any kind of use of the Program that is inappropriate or unauthorized. The User is not permitted to use the Program in any manner that might possibly result in the servers or networks owned or operated by the Developer becoming inoperable, overloaded, or otherwise degraded.

The Software is an original work and should be protected by intellectual property laws such as copyright since it should be considered an original work. The Developer currently has and will continue to hold all legal and equitable ownership rights to the Software as well as any and all interests therein. Users are in agreement that the Software does, in fact, include confidential business information that is shielded by intellectual property laws.

Regarding the Software, the Developer denies any express or implied guarantee of fitness or appropriateness for a particular purpose, and the Software is provided in its "AS IS" form. The developer does not guarantee that the program will perform as described or that it will be free of errors or other problems. The appropriateness of the User's use of the Software, including the selection, installation, usage, and consequences of the Software, is exclusively the User's responsibility.

For the avoidance of doubt, even if the Developer has been told of the potential of such damages, the Developer shall not be responsible for any direct, indirect, incidental, special, or consequential damages that arise out of or in connection with the use of or inability to use the Software. This includes damages of any kind, including but not limited to loss of data, loss of profits, loss of business, loss of goodwill, loss of business opportunity, loss of business information, loss of business information

This end-user license agreement will remain in effect indefinitely and until it is terminated. If the User deletes the Software, this End User License Agreement shall be terminated immediately. If the User commits a serious violation of this End User License Agreement (EULA), the Developer reserves the right to terminate this EULA. In the case that the User's license is being terminated, they are required to promptly stop using the Software.

This End-User License Agreement (EULA) will be construed and governed in accordance with the laws of the jurisdiction in which the Developer has its primary place of business, and no consideration will be given to any considerations of conflict of law.

This End-User License Agreement (EULA) is the full agreement between the User and the Developer with respect to the use of the Software and supersedes all prior agreements and representations between the parties with respect to the use of the Software. This EULA also replaces any and all representations made regarding the use of the Software.

Installation and use of the software by a user demonstrates that the user is in agreement with the terms and conditions of this End User License Agreement (EULA).

Upgrades & Updates to the Software The Developer reserves the right to roll out upgrades and updates at any point in time. The User is aware that these updates might be necessary for the Software to function correctly or to address any issues that have been brought to the User's attention.
